Isidro Arellano, CDM’s client, joined 5 other engineers from Mexico in a class-action lawsuit against Hyundai Mobis, Allswell, a staffing agency and SPJ Connect, a recruiting agency.
The case alleges that these workers suffered fraud, discrimination and wage violations and were exploited in a scheme for low-wage labor in Hyundai and Kia’s automotive supply chain in Georgia. The workers allege that the Defendant companies conspired to defraud Mexican workers and the U.S. government by taking advantage of the under-regulated TN Visa program, which operates with little to no federal oversight.
Isidro and his co-plaintiffs were recruited as engineers and scientific technicians under the TN visa program aimed at certain categories of professionals. However, once in the United States, they allege that they were put to work at entry level positions on the Hyundai Mobis production line and received wages far below those of their U.S.-born coworkers.
“We are proud to represent these brave workers in their fight for justice against these powerful corporations,” said Ben Botts, CDM’s Legal Director. CDM is litigating the case alongside the law firms of Hall & Lampros, LLP and Radford & Keebaugh, LLC.
